Nursing Home Abuse

Nursing Home Abuse is becoming more prevalent, as more of our aging population are becoming residents of nursing homes. The nursing home abuse ranges from medical malpractice to physical abuse. More than half of Texas nursing homes were found, in state inspections over the last several years, to have harmed residents through abuse or neglect, or placed their lives or health in jeopardy. A recent government report showed that only 16% of Texas nursing homes were in full or substantial compliance with federal regulations.

Unfortunately, the corporations who typically own these nursing homes are only concerned with profits, and cannot always be trusted to appropriately care for the family members we entrust to them. Experience has shown that some nursing homes try and hide their assets by funneling off most of the income to different corporations. Some nursing homes also choose to carry limited insurance. Many clients have asked the question "Why would the nursing home hide its assets and only purchase low insurance coverage for negligence claims?" The seemingly obvious reason would be that the nursing homes that do this have no intention of taking responsibility for their actions.

When a nursing home chooses to hide its assets and carry minimal insurance limits, it takes a diligent lawyer to help the victim find recoverable assets. Ed Sampson has helped many Texas families in suits against nursing homes and we know how to find their hidden assets. Some of the issues that have been encountered in the representation of victims in nursing home cases include physical abuse, medication errors, falls, bed sores and malnutrition.

If you think that you or a family member is a victim of nursing home abuse or malpractice, please consider an experienced, board certified attorney to protect your family's rights.
